The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

Explica cómo ésta, igual que la de María Zambrano, lleva la defensa amorosa del devenir de Nietzsche un paso más allá, en tanto nace de un interés por la otredad en sí misma y no de una voluntad de autoafirmación. La ruptura de las nociones convencionales de tiempo, espacio e identidad será una de las vías que utiliza. En ello puede apreciarse cierta similitud (...) con Muḥyī al-Dīn Ibn ʿArabī, de quien aprendió la necesidad de buscar un tiempo propio para el alma, diferente del cuantitativo y cuya doctrina del amor y de la santidad exige un genuino interés en la otredad en tanto otredad. -/- Abstract: The text is an attempt to approach the loving character of the writing of Maria Gabriela Llansol. It explains how her works, similarly to those of María Zambrano, go further than Nietzsche in the affirmation of the becoming: as long as there is not will of self-affirmation, but an authentic interest in alterity. One of the paths she explores is to break the conventional notions of time, space and identity. It is possible to appreciate two coincidences with Muḥyī al-Dīn Ibn ʿArabī. First, Llansol learned from him the need of an own time for the soul, different from quantitative time. Second, Ibn ʿArabī’s doctrine of love and sainthood also implies a genuine interest in otherness as otherness. (shrink)

El presente artículo es un estudio sobre las diferenciaciones (aqsām) del amor, uno de los puntos más importantes del principal escrito que Ibn ʿArabī dedicó a la cuestión amorosa, el capítulo 178 de Las Iluminaciones de La Meca (al-Futūḥāt al-Makkiyya). A través de un juego de oscilación y equilibrio entre perspectivas ontológicas y epistemológicas aparentemente enfrentadas –incomparabilidad/similaridad, oculto/manifiesto, unidad/multiplicidad, espíritu/cuerpo– y un recurrente manejo del lenguaje de las alusiones (išāra), el maestro andalusí distingue entre amor divino (ilāhī), espiritual (rūḥānī), natural (...) (ṭabī‘ī) y elemental (ʿunṣurī). This collection of essays focuses on the interface between delusions and self-deception.

The papers in this volume are drawn from a workshop on delusion and self-deception, held at Macquarie University in November of 2004. Our aim was to bring together theorists working on delusions and self-deception with an eye towards identifying and fostering connections—at both empirical and conceptual levels—between these domains. As the contributions to this volume testify, there are multiple points of contact between delusion and self-deception. This introduction charts the conceptual space in which these points of contact can be located (...) and introduces the reader to some of the general issues that frame the discussion of subsequent chapters. This essay explores some concerns about the quality of informed consent in patients whose autonomy is diminished by fatal illness. It argues that patients with diminished autonomy cannot give free and voluntary consent, and that recruitment of such patients as subjects in human experimentation exploits their vulnerability in a morally objectionable way. Two options are given to overcome this objection: (i) recruit only those patients who desire to contribute to medical knowledge, rather than gain access to experimental treatment, or (ii) (...) provide prospective subjects the choice to participate in standard doubleblind study or receive the experimental treatment. Either option would guarantee that patients in desperate conditions are given a more meaningful choice and a richer freedom, and thus a higher quality of informed consent, than under standard randomized trials. Background: The Declaration of Helsinki prohibits the publication of articles that do not meet defined ethical standards for reporting of research ethics board approval and informed consent. Despite this prohibition and a call to highlight the deficiency for the reader, articles with potential ethical shortcomings continue to be published.Objective: To determine what proportion of articles in major medical journals lack statements confirming REB approval and informed consent, and whether accompanying commentary alerts readers to this deficiency.Design: Retrospective, observational study.Setting: Online review (...) of five major medical journals.Population: All clinical research articles published online between 1 January 2005 and 31 December 2006 in the BMJ, Lancet, Annals of Internal Medicine, JAMA and the New England Journal of Medicine.Measurements: Statement of REB approval and informed consent.Results: Of 1780 articles reviewed, 1133 met inclusion criteria , 36 articles lacked a statement of REB approval, 62 lacked disclosure of informed consent and 15 articles lacked both. Articles that did not state REB approval were associated with not stating informed consent . There were no editorial comments to alert readers to the lack of either REB approval or informed consent statements associated with any of the deficient articles.Conclusions: Articles that lack explicit statements of REB approval and informed consent are infrequent but continue to be published in major medical journals without editorial statements to alert the reader to this deficiency. Background Intensive and critical care nurses need to demonstrate ethical sensitivity especially in recognizing and dealing with ethical dilemmas particularly as they often care for patients living with life-threatening conditions. Theories suggest that there is a convergence between nurses’ empathy and ethical sensitivity. Evidence in the literature indicates that nurses’ emotional, demographic, and work characteristics are associated with their level of empathy and ethical sensitivity. Aim To investigate the relationship between nurses’ empathy and ethical sensitivity, considering their emotional states (depression, (...) anxiety, and stress), demographic and work characteristics, and test an empirical model describing potential predictors of empathy (as a mediator) and ethical sensitivity using path analysis. Research design Using a cross-sectional design, the philosophical theory of care ethics and empathy was extended and adopted as a conceptual framework for this study and tested by path analysis. Participants and research context Data were collected from 347 intensive care nurses recruited by ten educational-medical hospitals in Iran using a questionnaire between February and March 2021. Ethical considerations The study was reviewed by the Ethical Advisory Board in Iran and conducted according to the Declaration of Helsinki. Findings Study participants demonstrated a mild level of stress, anxiety, and depression, alongside a relatively high level of empathy and ethical sensitivity. Nurses with good socioeconomic status had higher empathetic behavior with patients than those with weak status. Nurses aged over 40 who had received ethics training and had higher work experience were associated with higher ethical sensitivity compared to nurses under 20 years of age. Empathy directly affected ethical sensitivity; however, anxiety had an indirect effect on ethical sensitivity through empathy. Among demographic factors, age had a positive direct effect on ethical sensitivity. Conclusions Less anxiety and a high level of empathy contribute to higher levels of ethical sensitivity among intensive and critical care nurses. (shrink)

The growing body of research on interdisciplinarity has encouraged a more in depth analysis of the relations that hold among academic disciplines. In particular, the incursion of one scientific discipline into another discipline’s traditional domain, also known as scientific imperialism, has been a matter of increasing debate. Following this trend, Scientific Imperialism aims to bring together philosophers of science and historians of science interested in the topic of scientific imperialism and, in particular, interested in the conceptual clarification, empirical identification, and (...) normative assessment of the idea of scientific imperialism. Thus, this innovative volume has two main goals. Indeed, the authors first seek to understand interdisciplinary relations emerging from the incursion of one scientific discipline into one or more other disciplines, such as in cases in which the conventions and procedures of one discipline or field are imposed on other fields; or more weakly when a scientific discipline seeks to explain phenomena that are traditionally considered proper of another discipline’s domain. Secondly, the authors explore ways of distinguishing imperialistic from non-imperialistic interactions between disciplines and research fields. (shrink)

The purpose of this study is to examine how workgroup diversity can be managed through specific strategic human resource management systems. Our review shows that ‘affirmative action’ and traditional ‘diversity management’ approaches have failed to simultaneously achieve business and social justice outcomes of diversity. As previous literature has shown, the benefits of diversity cannot be achieved with isolated interventions. To the contrary, a complete organizational culture change is required, in order to promote appreciation of individual differences. The paper contributes to (...) this discussion by exploring the implications of this change for human resource management, and explaining how the systems of practices should be changed when they are directed to diverse groups. The model designed to test this notion includes: (1) demographic and human capital diversity as independent variables, (2) group performance (measured as innovation outcomes) as the dependent variable and, (3) the orientation of the strategic human resource management system as a potential moderator of this relationship. The main conclusion of the empirical analysis developed is that different patterns of human resource management practices can be used, depending on the type of diversity that the organization faces, and the specific effects that it wishes to manage. Concretely, three alternative management systems are identified in this paper, with different moderating effects. This result has interesting implications for human resource management professionals, explained in the last section. The limitations of this study are also discussed, as well as some issues that future research in this field should address. (shrink)

Background: Low rates of participation of adolescents and young adults (AYAs) in clinical oncology trials may contribute to poorer outcomes. Factors that influence the decision of AYAs to participate in health research and whether these factors are different from those that affect the participation of parents of children with cancer. Methods: This is a secondary analysis of data from validated questionnaires provided to adolescents (>12 years old) diagnosed with cancer and parents of children with cancer at 3 sites in Canada (...) (Halifax, Vancouver, and Montreal) and 2 in the United States (Atlanta, GA, and Memphis, TN). Respondents reported their own research participation and cited factors that would influence their own decision to participate in, or to provide parental authorization for their child to participate in health research. Results: Completed questionnaire rates for AYAs and parents were 86 (46.5%) of 185 and 409 (65.2%) of 627, respectively. AYAs (n = 86 [67%]) and parents (n = 409 [85%]) cited that they would participate in research because it would help others. AYAs perceived pressure by their family and friends (16%) and their physician (19%). Having too much to think about at the time of accrual was an impediment to both groups (36% AYAs and 47% parents). The main deterrent for AYAs was that research would take up too much time (45%). Nonwhite parents (7 of 56 [12.5%]) were more apt to decline than white parents (12 of 32 [3.7%]; P < .01). Conclusions: AYAs identified time commitment and having too much to think about as significant impediments to research participation. Addressing these barriers by minimizing time requirements and further supporting decision-making may improve informed consent and impact on enrollment in trials. (shrink)

La pandemia COVID-19 ha planteado retos, donde las TIC se ha convertido en una necesidad básica para la humanidad, en este contexto se cuestionó las capacidades de los docentes para hacer frente a los cambios. Tiene una metodología mixta pre- experimental, participaron 49 docentes y se aplicó cuestionario, rubrica y Pre Test/Post Test, con valores 0.890; 0.91, 0.97 de Cronbach. Los hallazgos demostraron que las dimensiones, comunicación, creación de contenidos, resultaron muy altas, mientras que la dimensión seguridad y solución de (...) problemas resultaron ser buenas. La investigación obtuvo resultados significativos para el desarrollo de las competencias digitales de los docentes de Piura. (shrink)

Legitimate corporations exist within a common space that is shared with a different type of organization, one that is engaged in illicit or criminal activities.Activities taking place in this sector of the global commons threaten the integrity of the global markets and contribute to public distrust of corporations. In addition, they are placing legitimate organizations in an unanticipated and unwelcomed role within a larger law enforcement regime that requires them to participate in preventing the legitimization of illicit monetary gains through (...) money laundering. This paper provides information on the global initiatives implemented to curb money laundering. It concludes with a discussion of needed research. (shrink)

Background and objective: Assuming the hypothesis that the general practitioner can and should be a key player in making end-of-life decisions for hospitalised patients, perceptions of GPs’ role assigned to them by hospital doctors in making withdrawal decisions for such patients were surveyed.Design: Questionnaire survey.Setting: Urban and rural areas.Participants: GPs.Results: The response rate was 32.2% , and it was observed that 70.8% of respondents believed that their participation in withdrawal decisions for their hospitalised patients was essential, whereas 42.1% believed that (...) the hospital doctors were sufficiently skilled to make withdrawal decisions without input from the GPs. Most respondents were found to believe that they had the necessary skills and enough time to participate in withdrawal decisions. The last case of treatment withdrawal in hospital for one of their patients was described by 40% of respondents, of whom only 40.0% believed that they had participated actively in the decision process. The major factors in the multivariate analysis were the GP’s strong belief that his or her participation was essential , information on admission of the patient given to the GP by the hospital department , rural practice , visit to the patient dying in hospital and a request by the family to be kept informed about the patient .Conclusion: Strong interest was evinced among GPs regarding end-of-life issues, as well as considerable experience of patients dying at home. As GPs are more closely corrected to patients’ families, they may be a good choice for third-party intervention in making end-of-life decisions for hospitalised patients. (shrink)

This book is an invitation to academic administrators, at every level, to engage in reflection on the ethical dimensions of their working lives.

Corporate social responsibility is increasingly viewed as a strategic management tool for companies to draw in candidates. In this arena, international responsible rankings such as ‘The Great Place to Work’, ‘Family Responsible Employer Index ’ or ‘The Best Companies for Working Mothers’ put emphasis on the value of responsible behaviours, not only for surviving in the market, but also to ‘win the war for talent’. Using a sample of Spanish University students, this research aims to analyse the process of selecting (...) responsible organizations to work and whether there is a possible future conflict of interest by students between their own and organizational values. Surprisingly, the university students assessed two opposing situations with the highest values: of looking to change employer and of letting time pass in order to ignore the conflict. The implications of the students’ assessments and the related factors which affect their decision-making criteria are explored in this article. (shrink)

La filosofía es una disciplina destacada, pues su metodología y principios aportaron bases a la ciencia moderna. No obstante, las particularidades de su lenguaje han sido poco estudiadas. Los estudios discursivos se han centrado últimamente en los diversos modos semióticos con que se construye el significado en los textos. Los géneros profesionales escritos de la filosofía tampoco han sido examinados desde este enfoque, quizás porque, en apariencia, se componen solo de un modo semiótico: las palabras. En este trabajo se identifica (...) el componente multimodal en 140 textos del corpus FIL-PUCV-UCSC-2018, proporcionados por filósofos chilenos. Se siguen las propuestas de Kress y van Leeuwen, Scollon y Scollon y Parodi. Se observó que, si bien predomina el modo verbal, existen otros modos semióticos que desempeñan relevantes funciones discursivas. (shrink)

Firstly we consider the new results about enzymatic capabilities in the RNA. In this framework we analyse the sequence-folding duality as a precursor of the genotype/phenotype duality. We discuss then which are the evolutive potentialities and limitations for a system with the absence and the presence of a nucleic acid to proteins translator code. We study the arise of the code in the living systems as a form of deep interlooking between the logic of the machinery and its hardware, discussing (...) some problems that abstract modelization of this process implies. La historia de la filosofía interpreta a Descartes desde la perspectiva del subjetivismo o solipsismo. De dónde procede tal interpretación y su plausibilidad desde los propios escritos de Descartes, son las dos cuestiones que trata de resolver este artículo. Para ello se ofrecen las lecturas de Hegel, Husserl y Heidegger. Como conclusión se muestra que la interpretación de Heidegger ha eclipsado otros puntos de vista.

BackgroundThe effectiveness of physical activity as an intervention against anxiety disorders and depression is undeniable in clinical psychology. Therefore, the question arose whether these effects also occur when a fear stimulus, like the COVID-19 pandemic, affects otherwise healthy adolescents. Boredom is closely linked to symptoms of fear and anxiety, but the connection between PA, boredom and fear is partly unclear.MethodsA cross-sectional online study was conducted that involved 122 students. Participants were 13–19 years old. The survey was available online from April (...) 27th to May 3rd, 2020. At this time, schools in Germany had already been closed for 6 weeks. A self-report questionnaire was used to measure physical activity, boredom, and fear of COVID-19. A multiple linear regression model was conducted.ResultsThe reported fear of COVID-19 significantly correlates with total PA, quantity of strenuous PA, and boredom. Furthermore, a significant regression equation was found. The variables boredom, PA, and age contribute significantly to predicting the fear of COVID-19 [R2 = 0.127, F = 6.876, p < 0.000], among adolescents.ConclusionOur results indicate that there is an association between PA, boredom and the quarantine experience of adolescents. Students who were physically more active, especially with strenuous intensity, did not feel bored and showed less fear of COVID-19. (shrink)
